Terms & conditions

Welcome to XR Playbook. We are an immersive marketing consultancy and advertising infrastructure provider helping innovative brands and agencies deploy repeatable, interactive campaign formats. By accessing or using our services, platform, or Format Library™, you agree to the following terms and conditions.

1. Definitions

  • "Company," "we," "our," or "us" refers to XR Playbook.

  • "Client," "you," or "your" refers to the business, brand, or agency engaging our services.

  • "Services" means the strategic consultancy (including XR Opportunity Mapping™), deployment frameworks, platform integrations, creative assets, code components, and interactive advertising frameworks provided by XR Playbook.

2. Services Provided

XR Playbook offers specialized immersive marketing advisory, interactive ad format software licensing via our Format Library™, technical campaign deployment support, and promotional or CRM platform integration configuration. Specific deliverables, sprint schedules, and subscription terms will be governed by an accompanying Statement of Work (SOW) or Digital Invoice.

3. Use of Services & Third-Party Dependencies

Clients agree to provide accurate, complete information necessary for the delivery of our services. You must not misuse our services or use them for unlawful activities.

You explicitly acknowledge that the deployment of WebAR experiences requires third-party software platforms (including, but not limited to, Zappar and HAILR) and local telecommunication data networks. XR Playbook is not liable for campaign interruptions, data drops, or tracking failures caused by downtimes, API changes, or network outages originating from these third-party infrastructure dependencies.

4. Fees and Payment

All fees will be outlined in a formal proposal, digital invoice, or contract. Payment terms are typically 30 days from the invoice date unless otherwise agreed in writing. Late payments may incur interest charges or the temporary suspension of active software licenses within the Format Library™.

5. Intellectual Property & Licensing

All proprietary code scripts, 3D interactive frameworks, game logic models, and technical architecture elements housed within the Format Library™ or created by XR Playbook remain the exclusive intellectual property of XR Playbook.

Upon full payment, the Client receives a non-exclusive, non-transferable, campaign-specific license to deploy the selected format for the agreed duration. White-label agency distribution, structural code scraping, or reproduction of the code frameworks for un-licensed campaigns is strictly prohibited unless explicitly transferred in writing.

6. Confidentiality & Data Processing (POPIA)

Both parties agree to maintain the confidentiality of all sensitive commercial strategies and campaign data shared during the course of the engagement.

To the extent that the Services involve integrating third-party promotional platforms to capture first-party consumer data (such as mobile numbers or email opt-ins), both parties agree to handle all personal information in strict compliance with the Protection of Personal Information Act (POPIA), No. 4 of 2013 of South Africa.

7. Liability

XR Playbook shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including data network costs incurred by end-consumers. Our total liability is limited to the exact amount paid by the client for the specific services or license layer provided under the applicable Statement of Work.

8. Termination

Either party may terminate an active engagement with written notice. Clients are responsible for immediate payment for all services rendered and configuration work completed up to the official date of termination.

9. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. The latest version will always be available on our website under our custom domain.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the appropriate courts located in Cape Town, Western Cape.
